Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under section 341, 294(b), 323 and 506(ii) of IPC in Crime No.281 of 2022 seeks anticipatory bail.

2. The petitioner herein along with other accused, with regard to the previous enmity with the defacto complainant has gone to the house of the defacto complainant and attacked him indiscriminately. The petitioner also sustained injury in a free fight and admitted in the hospital.

3. The learned Counsel appearing for the petitioner submits that, the petitioner being injured in the free fight, he may be granted anticipatory bail.

4. Considering the manner in which the accused persons unlawfully assembled with deadly weapons causing hurt to the defacto complainant, this Court is of the view that, grant of anticipatory bail to the petitioner will engage in retaliatory act and his custody is necessary to probe about his antecedents.
