ORDER

The petitioner apprehends arrest for the alleged offence under Section 4(1)(c), 4(1-A)(ii) of the Tamil Nadu Prohibition (Transport) Act, 1937 in Crime No.33 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that based on secret information, the respondent police found that the petitioner was in illegal possession of 32 brandy bottles (each containing 180 ml) with intention to sell the same to the public; hence the case.

3. The learned counsel appearing for the petitioner submitted that he is an innocent person and has been falsely implicated in this case. Earlier, he filed anticipatory bail in Crl.O.P.No.2003 of 2006 before this Court and the same was dismissed on 29.01.2026. He would submit that investigation is almost completed and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent submitted that there are seven previous cases pending against the petitioner and if anticipatory bail is granted, it will send a wrong signal to the society. Therefore, he opposed the petition.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. Considering the facts and circumstances of the case and also taking note of the fact that there are seven previous cases pending against the petitioner and if anticipatory bail is granted, there is every likelihood that the petitioner would commit similar kind of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
