Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents to consider the petitioner for the promotion to the post of Tester Grade I under the respondent Corporation , thereby promote the petitioner as Tester Grade I under Puducherry Power Corporation Limited, T.R. Pattinam, Karaikal, based on the educational qualification and service experience of the petitioner with all other monetary and service benefits as per the time frame fixed by this Court.

ORDER
The petitioner is presently working as Wiremen. His next avenue of promotion is to the post of Tester Grade-I. It is the grievance of the petitioner that there are sufficient vacancies available in Puducherry Power Corporation Limited for the purpose of giving him promotion.
The petitioner submitted a representation on 26 August 2014 requesting the second respondent to consider his case for promotion. Since there was no follow up action taken by the second respondent, the petitioner is before this Court.
2. The question as to whether the petitioner is eligible for promotion to the post of Tester Grade I is essentially a managerial function. The petitioner has already given representation to the second respondent. It is for the second respondent to take a decision in the matter.
3. The second respondent is directed to consider and dispose of the representation submitted by the petitioner dated 26 August 2014 on merits and as per law. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
