Common Prayer: Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to transfer the petitioner name from Contributory Pension Scheme to Old Pension Scheme prevailed prior to implementation of contributory pension scheme, based on the petitioner representation dated 12.01.2026.

Mr.M.R.Gokul Krishnan, Additional Government Pleader for RR-1 & 2 Mr.L.Murali Krishnan for R-4 COMMON ORDER These Writ Petitions have been filed seeking a direction to the respondents to transfer the names of the petitioners from Contributory Pension Scheme to Old Pension Scheme prevailed prior to implementation of contributory pension scheme based on the the petitioners representation, dated 12.01.2026.
2. Mr.M.R.Gokul Krishnan, learned Additional Government Pleader takes notice on behalf of respondents 1 & 2. Mr.L.Murali Krishnan, learned counsel takes notice on behalf of the 4th respondent. As no adverse order is being passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.
3. The petitioners were appointed as Lab Technicians in the Chemistry Department in Annamalai University on 01.11.2002 & 24.02.2003 respectively . Thereafter, their services were regularized. The grievance of the petitioners is that though they were appointed much prior to the issuance of G.O. (Ms).No.259, Finance (Pension) Department, dated 06.08.2003 which provides for Contributory Pension Scheme by cancelling the Old Pension Scheme, they were not brought under the Old Pension Scheme instead they were placed under Contributory Pension Scheme. Therefore, the petitioners submitted a representation dated 12.01.2026 to the respondents seeking to transfer their names from the Contributory Pension Scheme to the Old Pension Scheme. However, the said representation did not evoke any response from the respondents and therefore, in order to espouse the said cause, the present Writ Petitions have been filed.
4. Learned counsel appearing for the petitioners submitted that this Court may issue a direction to the respondents to consider the petitioners' representation dated 12.01.2026, within the time that may be stipulated by this Court.
5. Learned counsel appearing for the respondents submitted that the petitioners' representation will be considered and appropriate order will be passed.
6. In view of the limited relief sought for in these Writ Petitions, this Court without expressing any opinion on the merits of the case directs the respondents to consider the petitioners' representation dated 12.01.2026 and pass appropriate orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
7. The Writ Petitions are disposed of with the aforesaid direction. There shall be no order as to costs.
