When the matter is taken up for hearing today, the learned counsel appearing for the petitioner submits there is no instruction from the petitioner, hence the petition may be dismissed as withdrawn.

In view of the above submission, this Court finds that this criminal original petition was pending nearly about more than 1 year and there is no progress on the side of the petitioner, hence this Court is inclined to dismiss the criminal original petition and also directs the respondent police to secure the accused.

Accordingly, this criminal original petition is dismissed.
