Respondents PRAYER: The Writ Petition has been filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, to direct the 1st respondent herein to disburse the terminal benefits of Rs.4,01,598.56 which is due and payable to the petitioner and other Dearness Allowances applicable to him as per G.O. in force with 18% interest for such delayed payment. The instant Writ Petition has been filed for the issuance of a Writ of Mandamus seeking a direction for the payment of terminal benefits from the respondents.
2. The respondents had considered and passed an order as early as on 14.03.2007. However, the petitioner has given a reply only on 21.12.2015 disputing the sum arrived at by the respondents and submitted a calculation. The present Mandamus petition is filed seeking disbursement of the said amount. Such https://hcservices.ecourts.gov.in/hcservices/
a Mandamus may not be issued as the petition itself was filed before this Court after lapse of nine years.
3. However, this Court, without going into the merits of the case, directs the respondents to consider the representation given by the petitioner dated 21.12.2015 by considering the calculation given by him, and pass appropriate orders within a period of three (3) months from the date of receipt of a copy of this order.
