This Application coming on this day before this court for hearing the court made the following order: This Application had been filed seeking to condone the delay of 386 days in filing the written statement. 2.

The plaintiff and the defendant are husband and wife. The marriage still subsists though it is stated that divorce petition is pending. The plaintiff had instituted the suit seeking declaration of title and also seeking share in the rental income and for permanent injunction.

In view of the fact that pleadings are necessary to determine the issues between the parties and also upon hearing the learned counsel for the respondent/plaintiff, the delay is condoned and the written statement with counter claim is taken on file and this Application is allowed.

Time is granted to the plaintiff to file reply statement within the time prescribed under the Original Side Rules. Call the matter on 23.03.2018.
