ORDER
This Writ Petition has been filed to direct the respondents to assign the lands morefully disclosed in the prayer to this writ petition in favour of the petitioners and thereafter, issue separate patta in their favour for the subject properties.
2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents.
3. The petitioners have filed supporting documents along with this writ petition in respect of their case for assignment of the subject lands and for issuance of separate patta in their favour. This Court is not expressing any opinion on the merits of those documents. Page No.2 of 7
4. The petitioners claim that they are landless poor and that they are entitled for assignment and for issuance of separate patta. They claim that they are in possession of the subject properties. As seen from the documents filed along with this writ petition, the petitioners' representation seeking for assignment and for issuance of separate patta does not find a place. Necessarily, the petitioners will have to submit a fresh representation to the respondents seeking for assignment and for issuance of separate patta.
5. The learned counsel for the petitioners, on instructions, would submit that the petitioners are willing to submit a fresh representation to the respondents.
6. No prejudice would be caused to the respondents, if the petitioners' representation is considered on merits and in accordance with law, within a time frame to be fixed by this Court.
7. For the foregoing reasons, the petitioners are directed to submit a fresh representation with the 1st respondent seeking for assignment of Page No.3 of 7
the lands morefully disclosed in the prayer to this writ petition and for issuance of separate patta in their names, within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said representation within the stipulated time, the 1st respondent shall pass final orders, on merits and in accordance with law, within a period of twelve (12) weeks thereafter, after giving due consideration to the supporting documents filed by the petitioners.
8. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
