The petitioners, who were arrested and remanded to judicial custody on 13.01.2026, for the offence punishable under Sections 103 of BNS @ 191(2), 61(2), 126(2), 87, 103, 238 of BNS in Crime No.16 of 2026, registered on the file of the respondent, seeks bail.

The case of the prosecution is that A1 is the sister-in-law of the deceased in this case and since the wife of A1 has deserted him, it is suspected that, A1 was having some close relationship with the mother-in-law and hence A1 and others conspired and abducted the deceased in this case and attacked him with stones and thrown him on the road after that he was become unconscious. Next day, they went to place of occurrence, again throw stones on the deceased, murdered him, thereafter thrown the body into the lake. Hence, the case.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that they are not having previous case and on suspicion, they were arrested. Hence, he prayed to grant anticipatory bail to the petitioners.
4. The learned Government Advocate (crl. Side) reiterated the prosecution case and submitted that investigation is pending and petitioner is also having specific overt act of abducting the deceased and assisted A1 to 2/4
attack and commit murder. Hence, he opposed for grant of bail to the petitioner.
5. Considering the nature of allegations, and also overtact attributed against him is also serious in nature, and if the petitioner is granted bail, it would hamper investigation, hence, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 26.02.2026 sma 3/4
