The petitioner, who was arrested and remanded to judicial custody on 13.01.2026 for the alleged offence under Sections 103 of BNS @ 191(2), 61(2), 126(2), 87, 103, 238 of BNS, in Crime No.16 of 2026 on the file of the respondent Police, seeks bail.

The case of the prosecution is that the defacto complainant is sister of deceased Arumugam and the deceased person was working as salesman in a Pharma Distribution Company namely Lifeline Pharma and he used to come back to home before 08.00 PM and that on 07.01.2026, he did not return back to house and on suspicion, the complainant conducted enquiry in the said pharma company and she was told that at about 09.00 PM, the deceased person informed the company that he distributed the medicines in hospitals and went to bus stand to send medicines to Hosur and the deceased person not yet come back to his house. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case and has been in custody since 13.01.2026. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and undertakes not to tamper with the witnesses. Hence, he prayed for grant of bail.

4. The learned Government Advocate (Crl. Side) would submit that the investigation is pending and in this stage, if the petitioner is released on bail he may abscond and tamper with witnesses and hence, he opposed the 2/5

grant of bail.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. The petitioner in Crl OP No.5319 of 2026 is A6 and the petitioner in Crl OP No.5370 of 2026 is A2. According to the prosecution, the deceased is the husband of A6, since he spread rumor that A6 is having affair with the first accused, A1 and A4 has murdered the deceased on 07.01.2026. It is the specific submission of the learned Government Advocate that A6 and A2 conspired in the murder, and that the investigation is in preliminary stage and this accused arrested only on 13.01.2026.

7. Having considered the submissions of the learned Government Advocate, this Court is of the view, it is not desirable to grant bail to the petitioner at this stage.

Accordingly, this Criminal Original petition is dismissed. 03.03.2026 mtl 3/5
