The present petition has been filed to modify one of the condition imposed on the petitioners in Paragraph No.9(b) of the order dated 15.02.2023 passed by this Court in Crl.O.P.No.3138 of 2023 while granting anticipatory bail.

The learned counsel for the petitioner would submit that one of the conditions imposed on the petitioners is that " the first and third petitioner should deposit a sum of Rs.10,00,000/- each totally Rs.20,00,000/- and the second petitioner shall deposit a sum of Rs.23,00,000/- to the credit of Cr.No.66 of 2023 before the Judicial Magistrate concerned within a period of two weeks from the date on which the order copy made ready" He would further submit that due to By-Election at Erode Constituency in Tamil Nadu, the petitioner is not able to carry the cash to deposit the said amount in the crime number as per order of this Court, but, the petitioners are ready to deposit a sum of Rs.43,00,000/- through demand draft. Hence, he would seek to modify the aforesaid condition. 1/3

3. Heard the learned Government Advocate (Crl. Side) appearing for the respondent police.

Taking into consideration, the facts and the submissions made by the learned counsel for the petitioner, this petition is allowed by modifying the condition to the effect that " the petitioners are directed to deposit a sum of Rs.43,00,000/- through demand draft drawn in favour of trial court ie., Judicial Magistrate-II, Salem and further two weeks time is extended to deposit the same. All other conditions remain intact.

5. With the above modifications, this Criminal Miscellaneous Petition is allowed.
