O R D E R
This Criminal Original Petition has been filed praying to investigate the matter expeditiously and file a final report in connection with Crime No.550 of 2012.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.
3. Today, Mr.A.Thavamani, Inspector of Police, Udumalpet Police Station is present and he has filed a status report, wherein in paragraph nos.10 & 11, it is stated as follows : "10. It is submitted that so far the investigation reveals that the defacto-complainant made allegations as against one Parthasarathy, son-inlaw of the Sampathkumar. But the same was denied by the said Parthasarathy while he was examined. He has stated that during the alleged occurence, he was at Chennai and not at Udumalpet. To that effect, he also furnished Lodge receipt to prove his stay at Chennai on 02.7.2012 [the date of alleged occurrence took place] and further produced the return Bus ticket dated 3.07.2012 of SRM Travel from Chennai to Udumalpet.
11.It is submitted that now the investigation is in a crucial stage. Still, the respondent police have to do the following :- - The alleged accused person, Parthasarathy has to be examined and the documents, such as Bus Ticket, Lodge Receipt etc., furnished by him have also to be verified and ascertained to prove the case.
- Further, the phone call details of the cell phone of Parthasarathy [Cell No.9626255433, 9600055533] have to be collected from the concerned telephone authorities.
Only after completion of the above, the respondent police can proceed further in this case. Hence, for the above said reasons, the case is still under investigation.
However, as soon as complete the investigation, the respondent police lay a final report against the concerned accused in accordance with law at the earliest."
