This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.403 of 2025, on the file of the respondent Police.

The case of the prosecution is that the petitioner, along with other accused, was found to be in illegal possession of TAPENTADOL HYDROCHLORIDE TABLETS and hence, the aforesaid FIR was registered for the offence under Section 123 of the Bharathiya Nyaya Sanhita (BNS) 2023, in Crime No.403 of 2025 on the file of the respondent police.

3. Learned counsel appearing for the petitioner would submit that there is absolutely no material available to show that the petitioner has any direct role in the scene of occurrence. Hence, he prayed to quash the First Information Report pending against the petitioner.

Per contra, the learned Additional Public Prosecutor appearing for the respondent would submit that investigation has been completed and the final report is ready.

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking note of the fact that investigation has been completed, this Court does not find any merit in this petition to quash the First Information Report. 2/4

Accordingly, this Criminal Original Petition stands dismissed. However, liberty is granted to the petitioner to challenge the final report, if so advised.
