(Order of the court was made by R.Mahadevan, J.) Seeking to grant leave to file contempt petition, the petitioner has filed this sub application.
2.It is stated in the affidavit filed in support of this sub application that the petitioner is the wife of one Y.J.Mathan, who had worked as office assistant in the respondent Department. He was subjected to disciplinary action and resultantly, was imposed with the punishment of compulsory retirement vide order dated 13.12.1999, which was challenged by him by filing WP.No.2918 of 2006 and the said writ petition was allowed. However, the respondent filed WA.No.578 of 2021 as against the order passed in the writ petition. During the pendency of the same, the husband of the petitioner / Government servant died on 08.01.2018 and the same was communicated to the respondent on 1/3
12.01.2021. Subsequently, the writ appeal was dismissed on 19.04.2021, with a direction to implement the order passed in WP.No.2918 of 2006. Even thereafter, the order has not been complied with by the respondent. Several representations sent by the petitioner in this regard, evoked no response. Therefore, the petitioner / wife of the deceased Government servant, sought leave of this court to file contempt petition against the respondent. 3.Heard both sides. The learned Additional Government Pleader appearing for the respondent has no serious objection for ordering this petition. 4.Considering the reasons stated in the affidavit filed in support of this petition and also having regard to the no objection expressed on the side of the respondent, leave is granted and this petition is ordered accordingly.
