ORDER

This Writ Petition has been filed for a Writ of Mandamus, directing the first respondent to appoint the petitioner to the post of Village Assistant either at Konai Village or at Pazhavalam Village, Gingee Taluk following the letter issued by the third respondent dated 09.01.2025 in Na.Ka.No.2E-16981432024.

The case of the petitioner is that 15 cents of land belonging to her family had been taken over by the fifth respondent and she is eligible for Government appointment under G.O.Ms.No.324, Revenue dated 18.03.1986. The petitioner has submitted a representation to the District Collector. The District Collector, by communication dated 09.01.2025 in e/f/vz;/2?E?1698143?2024. had forwarded the same to Thasildar, Gingee/fourth respondent. Contending that no further action has been taken, the petitioner has come up with the present Writ Petition. 3/7

Mr.S.Sadasharam, learned counsel for the petitioner submitted that the petitioner's family land to an extent of 9 cents of land had been taken over by the Government and as per G.O.Ms.No.324, Revenue dated 18.03.1986, the petitioner is eligible for employment assistance. The petitioner has given a representation to the Special Personal Assistant of the Minister for Revenue and Disaster Management. The representation has been forwarded by the District Collector to the fourth respondent and till date, no action has been taken. Hence, the petitioner has approached this Court.

The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's husband Mr.Murugan had given his land for usage as a general public road under a gift deed in favour of Commissioner, Gingee Panchayat Union, vide Doc.No.34 of 2018 dated 10.01.2008. However, there is no undertaking given to the petitioner or her husband that she would be compensated by way of employment, as averred by the writ petitioner. He would further submit that the petitioner's husband Mr.Murugan is employed as a Conductor in Tamil Nadu State Transport Corporation and therefore, the case of the petitioner will not fall under 4/7

G.O.Ms.No.324 Revenue dated 18.03.1986. However, he admitted that despite the forwarding of the petitioner's representation to the fourth respondent to give a reply, no action has been taken by the fourth respondent.

5. A perusal of the records shows that the third respondent has forwarded the representation of the petitioner to the fourth respondent vide e/f/vz;/2?E?1698143?2024. however, it has not been acted upon.

6. In view of the above, this Writ Petition stands disposed of directing the fourth respondent to dispose of the representation of the petitioner in accordance with law and on its own merits, within a period of 12 weeks from the date of receipt of a copy of this order.
