The petitioner seeks bail in Crime No.5 of 2023, registered by the respondent for the offences punishable under Sections 354, 376(2)(n), 312 and 417 IPC. The petitioner had been taken into custody on 28.01.2024.

2.After completing investigation, final report had been filed before the Judicial Magistrate, Gummidipoondi. The Court had also examined the statement of the victim recorded under Section 164(5) Cr.P.C. She had very clearly stated about the sexual assault made by the petitioner herein and also of the fact that she attempted to commit suicide owing rejection after she had become pregnant. On the first occasion, she took tablets and on the second occasion, she cut her hands. On both the occasions, she was rescued after treatment.

3.Let the trial be completed. At this stage, I am not inclined to grant bail to the petitioner, since there is every possibility of the petitioner again absconding from judicial process as he is from Odissa. https://www.mhc.tn.gov.in/judis
