ORDER
The petitioner, who was arrested and remanded to judicial custody on 25.01.2026 for the alleged offences under Sections 126(b), 296(b), 309(4), 311 of BNS 2023, in Crime No.59 of 2026 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioners abused the defacto complainant, who is running a old scrap shop using filthy language, assaulted him using knife and robbed a sum of Rs.2,150/-; that further threatened the defacto complainant of dire consequences. Hence, this case 3.
The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and the petitioners are in judicial custody since 25.01.2026; and that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioners reiterated the prosecution case and stated that there are totally two accused involved in this case and the petitioners are arrayed as A1 and A2; and that the 1st petitioner is having 11 previous cases and the 2nd petitioner is having 6 previous cases and that the investigation of the case is pending.

Considering the facts of the case, nature of allegation and the period of incarceration undergone by the petitioners, this Court is inclined to grant bail. Although it is noted that the petitioners have prior criminal records,
bail is granted subject to certain conditions. 6.
Accordingly, the petitioners are ordered to be released on bail on their executing a separate bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties each, for a like sum to the satisfaction of the learned District Munsif-Cum Judicial Magistrate, Madhavaram, and on further conditions that:
[a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioners shall report before the learned District Munsif-Cum Judicial Magistrate, Madhavaram daily at 10:30 a.m., for a period of four weeks;
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 of B.N.S.
