Mr.S.Santhosh, GA (Crl.Side) for R1 to R3 Mr.K.S.Arumugam for R6 & R7 Order This Writ Petition (Criminal) has been filed to direct the respondents 1 and 2 to take action against the 3rd respondent for conducting Kattapanchayat and consequently, direct the 3rd respondent not to interfere in the civil dispute except under due process of law.

When the matter is taken up today for hearing, the learned Government Advocate appearing for the respondents 1 to 3 would submit that based on the complaint given by the sixth respondent that the petitioner, along with her husband and son, had abused him and intimidated him, a case in Crime No.55 of 2026 has been registered against them for the offences under sections 126(2), 296(b), 115(2), 118(1) & 351(2) of BNS and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act. The petitioner has also given a counter complaint against respondents 4, 6 & 7, in respect of which, an inquiry is being conducted in CSR.No.207 of 2026. It appears that a civil dispute is pending between the petitioner and the respondents 6 & 7. The third respondent police is not interfering in the civil dispute between the parties.
3. At this juncture, Mr.S.Thangavel, learned counsel for the petitioner would submit that when the matter is taken up in the morning, the respondents 6 & 7 have parked the JCB machine in front of the shutter of their shop preventing entry of the petitioner into the property.
4. Mr.K.S.Arumugam, learned counsel for R6 & R7 would submit that the JCB machine has now been removed.
5. Recording the submission made by the learned Government Advocate (Crl.Side) that the third respondent police is not interfering with the civil dispute between the parties and also the submission made by the learned counsel for the respondents 6 & 7, this Writ Petition (Criminal) stands closed. It is made clear that this Court has not made any observation with regard to title or ownership of the property. It is for the parties to approach the appropriate Civil Court seeking appropriate relief.
