Respondents (R4 Suomotu impleaded as per order dated 19.11.2013 by NKKJ in WP.30996/2013) Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of Mandamus, to direct the 2nd respondent to sponsor the petitioner name to the third respondent for the post of Village Panchayat Secretary at Naduvalur Panchayat based on the petitioner's representation dated 16.08.2013 and consequently direct the first respondent to appoint the petitioner for the post of Village Panchayat Secretary at Naduvalur Panchyat.

ORDER

This Writ Petition has been filed by the petitioner, to direct the 2nd respondent to sponsor the petitioner's name to the third respondent for the post of Village Panchayat Secretary at Naduvalur Panchayat based on the petitioner's representation dated 16.08.2013 and consequently direct the first respondent to appoint the petitioner to the post of Village Panchayat Secretary at Naduvalur Panchyat.

2.When the matter was taken up today for hearing, learned counsel appearing for the petitioner submitted that though the prayer in the writ petition is to sponsor the petitioner's name to the 3rd respondent, however it would suffice to issue a direction to the 1st respondent to consider the representation dated 16.8.2013, within a reasonable time as fixed by this court in accordance with law.

3.On the above contention, this Court heard the learned Special Government Pleader appearing for the respondents, who has no serious objections to such a direction being passed. 4.In view of the limited relief sought for, this Court without going into the merits of the issue, directs the petitioner, to submit a copy of the representation dated 16.8.2013, along with a copy of this order to the 1st respondent, within a period of one week from the date of receipt of a copy of this order and on such representation being filed, the 1st respondent is directed to consider the same and pass orders thereon in accordance with law within a period of three months thereafter.

5. With the above direction, this writ petition is disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
