ORDER
The petitioner has filed this Criminal Miscellaneous Petition seeking to relax the condition imposed on him in Para No.8(iv) of the order dated 20.04.2016 in Crl.MP.No.4530 of 2016 in Crl.A.286 of 2016.
2.Learned counsel for the petitioner submits that this Court, vide order dated 20.04.2016, was pleased to allow the Crl.MP.No.4530 of 2016 in Crl.A.286 of 2016 and granted suspension of sentence on condition that the petitioner shall appear on the first working day of every month at 10.30 a.m. before the Special Judge until further orders. He further submits that the petitioner is a senior citizen aged about 70 years and to date, he has consistently complied with the conditions imposed by this Court.
3. Learned Government Advocate (Crl. Side) appearing for the respondent has no objection to the modification sought by the petitioner.
4. In view of the above and considering the submissions made by the learned counsel for the petitioner, this Court is of the considered view that the prayer sought by the petitioner may be acceded to.
5. Accordingly, the condition imposed on the petitioner in Crl.M.P. No. 4530 of 2016 in Crl.A. No. 286 of 2016 vide order dated 20.04.2016, requiring him to appear before the Special Judge on the first working day of every month at 10.30 a.m. until further orders, is hereby modified. The petitioner shall now appear before the Special Judge once every three months, effective from 01.04.2026, and thereafter, on such days as may be fixed by the learned Special Judge. In the event, the petitioner is unable to appear before the Trial Court on
any scheduled date, he shall file an application under Section 317 of the Cr.P.C. and shall appear on an alternative date in lieu of his absence, as directed by the Trial Court.
