ORDER

The present Petition has been filed to direct the respondents 1 and 2 to provide adequate police protection to the petitioner's property and her men in the property and enable her to enter into the property so as to save the Petitioner's Property from being grabbed by 3rd respondent and his men.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents 1 and 2 and perused the documents placed on record.

According to the petitioner, the petitioner purchased a plot of land admeasuring 2,400 sq.ft., along with the house built on it, located at Plot No.4, Maraikkayar Nagar, Blue Beach Road, Neelangarai, Chennai by way of a registered sale deed vide document no.11132 / 2023 dated 25.08.2023, however, the petitioner is not able to take possession of the suit property from the hands of the 3rd respondent and the 3rd respondent was threatened by other politically influenced persons. Therefore, the petitioner lodged complaint seeking police protection to enter into her property.

On an earlier occasion, viz., 24.03.2026, on the submission of the learned counsel appearing for the petitioner, this Court directed the Deputy Commissioner of Police, Adyar to conduct personal enquiry into the matter. In compliance with the said direction, the Deputy Commissioner of police, after completion of enquiry, submitted a report. The said report revealed that the petitioner had purchased the subject property for the sale consideration of Rs.2 Crores. However, the registered sale deed reflects a sum of Rs.1.45 Crores and the petitioner yet to pay the balance amount to the 3rd respondent herein. That apart, the 3rd respondent is residing in the ground floor of the premises, as permitted by the petitioner. Further, the petitioner had taken possession of the 1st floor of the house premises and rented out to 3rd party, however, nothing has been whispered in her petition.

Besides the above, only on the submission of the learned counsel for the petitioner, this Court, on 24.03.2026, directed the Deputy Commissioner of Police, Adyar to conduct enquiry, now, enquiry revealed that the petitioner had already taken possession of the 1st floor of the property and with her permission only, the 3rd respondent is residing in the ground floor. One Mr.Selvakumar advanced a sum of Rs.1 Crore to the 3rd respondent to purchase the subject property, however, suppressing the same, the 3rd

respondent sold out to the petitioner herein. Now, the said Selvakumar has filed a suit in O.S.No.257 of 2026, in respect of the very same property before the District Court, Chengalpattu and it is pending for adjudication. Further, the 3rd respondent and Selvakumar are also residing in the disputed property and pending sale consideration and pending civil suit, the petitioner is not able to take possession of the property. That apart, in order to take possession of the property, police protection cannot be granted and the 3rd respondent is also claiming right over the subject property and O.S.No.257 of 2026 is also pending on the file of the District Court, Chengalpattu, therefore, the present petition is devoid of merits and the present petition is liable to be dismissed.
