O R D E R

This petition has been filed seeking to quash the FIR in Crime No.582 of 2021, registered under Sections 465, 468, 471 and 109 of IPC, on the file of the 1st respondent police.

2.The case of the petitioner is that the defacto complainant/Block Development Officer (BDO), Thiruporur lodged a complaint against one Mrs.Renuka (A1) working as Convergence (Livelihood Coordinator), Mahalir Thittam and the petitioner (A2), who is working as Block Mission Manager, Mahalir Thittam, Thiruporur Panchayat Union, Tiruporur Taluk and Chengalpattu District, alleging that both the above said persons have collected a sum of Rs.3,500/- from each person/beneficiary women in total to tune of Rs.87,500/- for providing fake driving licence for two wheelers to the women who are in Self Help groups.

3.The grievance of the petitioner is that the respondent police failed to note the fact that the petitioner was in service at Thirukazhukundram Block, she came to understand that one Mrs.Renuka (A1) collected money for providing two wheeler license from some Self Help groups. Based on the complaint received from the affected persons, she lodged a complaint before the Higher Officials against A1 and thereafter, the FIR was registered. Therefore, the petitioner is only a complainant and there is no role on her part in the alleged offence. He further submitted that there is no specific complaint against the petitioner herein lodged by any public or affected person either before the higher officials of the petitioner or the police. The above criminal proceedings is instituted manifestly with mala fide intention. Hence, FIR in Crime No.

582 of 2021 is liable to be quashed as against the petitioner herein. 4.The learned Additional Public Prosecutor submitted serious allegations have been made against the petitioner and the same cannot be quashed at the threshold. Hence, he opposed for quashing the charges.

5.In view of the serious nature of allegations leveled against the petitioner which requires thorough investigation, this Court is not inclined to quash the FIR at the threshold.
