ORDER

This Writ Petition has been filed seeking a direction to the respondents consider the petitioner's representation 26-12-2025 to deduct a sum of Rs.10,000/ - being one third of petitioner's basic salary towards recovery of his loan dues as per decree, dated 22-08-2025 passed in Case No.05-0009 /2024 -2025 on the file of Co- operative Sub-Registrar, Chennai.

2. Mr.R.Muruga Bharathi, learned counsel takes notice on behalf of the 1st respondent. Mrs.S.Pavithra, learned counsel takes notice on behalf of the 2nd and 3rd respondent.

3. The petitioner is working as a conductor in the depot of the 2nd respondent. The petitioner had availed loan from the 1st respondent for a sum of Rs.7,90,000/-. Due to default in repayment of the said loan amount, the 1st respondent approached the authority under the Tamil Nadu Co-operative Societies Act. Pursuant thereto, an award dated 22.08.2025 was passed by the Co-operative Sub-Registrar, Chennai directing the petitioner to pay a sum of Rs.9,81,111/-. In view of the said award, the 1st respondent issued a direction to the 3rd respondent to deduct a sum of Rs.30,000/- on an average per month.

After such deduction, the petitioner is receiving only a paltry sum of Rs.12,500 per month which is insufficient to meet the basic needs of his family. Therefore, the petitioner submitted a representation to the respondents on 26.12.2025 requesting them to restrict the deduction to one-third of his salary. However, the said representation was not considered. Hence, the present Writ Petition has been filed.

Learned counsel appearing for the petitioner submitted that, after deduction of the amount towards the loan, the petitioner is left with only a paltry sum, with which, he is unable to maintain his family. Therefore, he prayed that this Court may fix a reasonable amount to be deducted from the petitioner's salary towards the decretal amount.

5. Learned counsel appearing for the 1st respondent submitted that, this Court may fix the reasonable amount to be deducted from the petitioner's salary towards the decretal amount.

6. Taking into consideration of the learned counsel appearing for the respondents, there shall be a direction to the respondents to deduct a sum of Rs.20,000/- from the salary of the petitioner every month towards decretal amount and that such deduction shall continue till the date of realization of the entire decretal amount.

7. The Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs.
