Respondents Prayer : Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of habeas corpus directing the 2nd respondent to produce the body of the petitioner's minor daughter S.Bhavani, aged 17 years who is under the illegal custody of the 3rd respondent and hand over the custody of S.Bhavani to the petitioner herein. ORDER

(Order of the Court was made by C.T.SELVAM, J.) Petitioner, father of the detenu S.Bhavani, has moved this petition to cause production of his minor daughter, who is said to be in the illegal custody of the 3rd respondent herein, before this Court and to hand over her custody to him. The 2nd respondent police has produced the minor girl, informing that she was secured yesterday [18.03.2018], having been found in the custody of 3rd respondent, against whom initially, a case in Cr.No.43/2018 has been registered for offence u/s.366-A IPC by the 2nd respondent, presently https://hcservices.ecourts.gov.in/hcservices/

stands altered to one u/s.366-A IPC and section 4 of Protection of Children from Sexual Offences Act, 2012. Detenue, minor girl, has informed her intent to return to her parental home with her father, petitioner herein, who is present before us. He is also agreeable to such a course.

In the circumstance, the Habeas Corpus Petition is closed.
