O R D E R

The Contempt Petition has been filed to punish the respondent for her willful disobedience of the order of this Court in W.P.No.1087 of 2024 dated 18.01.2024.

2.When the matter was taken up for hearing, an affidavit was filed 1/4

on behalf of the respondent an the relevant portions are recorded hereunder:

"8.I submit that after receipt of the complaint dated 06.01.2024 sent by the petitioner by RPAD, on 17.02.2024, I have issued summon to both the petitioner and counter petitioner to appear before me for enquiry and the same was duly acknowledged by them on the same day.

Both of the them appeared for enquiry before me on 18.02.2024 and recorded the statement of them. The counter petitioner gave a statement in writing that he will not continue with the construction works in the Property. During enquiry, both of them arrived at a compromise. 9.I submit that during the further course of enquiry, it reveals that subsequently during the night time, the counter petitioner carried out the construction and the same was not came to the knowledge of the respondent police. When the entire stock of the police force were deployed in the bundobust duty the counter petitioner taking advantage of the situation in their favour and carried out the construction of shops in Survey No.80/1B7 at Gurugapatti Village.

10.I submit that after enquiry, on 25.05.2024, the petitioner again lodged a complaint before the respondent police stating that eh counter petitioner trespassed into the land and abused the complainant in filthy languages. Based on that a case was registered in Singarapettai Police Station in Cr.No.149 of 2024, u/s.294(b), 341, 447, 506(ii) IPC on 25.05.2024 at about 20.00 hours by Tr.Annamalai, Sub Inspector of Police and submitted before me for investigation and I took up the case for investigation."
