ORDER
This writ petition has been filed challenging the impugned online rejection order passed by the 2 nd respondent dated 24.01.2025 and for a consequential direction to the 2 nd respondent to issue patta in favour of the petitioner based on the application submitted on 07.11.2024. 2.Heard Mr.C.Prabakaran, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of the respondents 1 and 2.
3/6 3.The petitioner is claiming right over the subject property by virtue of a decree passed in O.S.No.10 of 2023 on the file of the learned District Munsif cum Judicial Magistrate, Pennagaram dated 27.02.2003. The petitioner sought for subdivision of the property and for issuance of patta. On receipt of the same, the 2 nd respondent rejected the same through an online order dated 24.01.2025 without assigning any reasons except stating that there is a dispute pending regarding the property.
4.In the considered view of this Court, the online rejection order passed by the 2 nd respondent is bereft of any reasons and on that ground alone, the same is liable to be interfered by this Court. Accordingly, the online rejection order passed by the 2 nd respondent dated 24.01.2025, is hereby quashed. There shall be a direction to the 2 nd respondent to deal with the application submitted by the petitioner on 07.11.2024 after giving opportunity to the petitioner and based on the documents submitted by the petitioner and appropriate orders shall be passed, within a period of six weeks from the date of receipt of copy of this order. If there are any rival claimants, notice shall be issued to them before passing final orders.
