Seeking leave to sue the respondent, the applicant/plaintiff has come up with this application.
2.The applicant is the plaintiff in the suit filed for recovery of money pursuant to the sale deed said to have been executed between the parties.
3.Learned counsel appearing for the applicant submits that the sale deed has been executed by the respondent by suppressing the joint development agreement with the third party, which in turn, resulted in the loss of money to the applicant. Learned counsel further submits that the sale deed has been executed within the territorial jurisdiction of this Court, which also indicates the consideration paid. 4.Considering the submissions made by the learned counsel for the applicant and the averments made in the plaint, leave is granted. 12.09.2016 mmi
