ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.02.2026, for the alleged offence punishable under Sections 275, 123, 112 of

BNS Act, 2023 r/w. 24(1) of COTPA Act in Crime No.55 of 2026 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner herein joined hands with other accused involved in illegally transported totally 245 kgs of banned tobacco products and the petitioner was arrested on 02.02.2026.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and is in judicial custody from 02.02.2026 and is not having any previous case. Hence, he prayed for grant of bail to the petitioner.

4. The Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that totally 7 accused in this case, the petitioner is ranked as A7 and the petitioner joined hands with other accused transported huge contraband in two wheeler and from the petitioner alone 36 kgs of banned tobacco products were recovered. Hence, he opposed for grant of bail to the petitioner.

5. I have gone through the FIR and connected materials and it revealed that total quantity involved in this case is 245 kgs and though it is stated that no previous case reported against the petitioner, considering huge quantity

involved in this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 25-02-2026 MPA To
