This petition is filed under Section 378(4) Cr.P.C, to grant special leave to file an appeal against the order dated 25.11.2022 made in S.T.C. No.668 of 2015 on the file of the learned Judicial Magistrate No.I, Coimbatore.

2. Mr.R. Prabhakaran, learned counsel for the petitioner contended that the accused had admitted his signature on the cheque and though he did not adduce any acceptable oral/documentary evidence to rebut the presumption under Sections 118 and 139 of the Negotiable Instruments Act, the trial court had acquitted him under Section 255(1) Cr.P.C.

3. In the circumstances, there are some arguable points in the present appeal and accordingly, special leave is granted. 1/2 https://www.mhc.tn.gov.in/judis
