ORDER

The petition has been filed to direct the respondent to provide electricity connection to petitioner commercial property which is situated at Plot No.37,

No.5/2 (78/2), 10th Avenue, Ashok Nagar, Chennai 600083 by considering the petitioners vide Application Acknowledgement NO. 200009238012692 dated 19.01.2026.

2. It is the case of the petitioner that he is residing in the above mentioned address which belongs to Tamil Nadu Housing and Urban Development Department. The petitioner would submit that he and his family members are residing in the said premises for over 35 years and are running a cardboard business. Therefore, the petitioner made an application dated 19.01.2026 for electricity connection. Since there was no action till date, aggrieved petitioner is before this Court.

3. Per contra, the learned Standing Counsel appearing for the respondent would submit that since the said premises belongs to the Slum Clearance Board, no objection is required from the said Board to provide electricity to the petitioner.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Though the said premises belongs to the Slum Clearance Board, it is seen that the Board has not disturbed the possession of the petitioner till date.

Therefore, there is no impediment as such for the respondent to give the electricity service connection. Therefore, the respondent is directed to consider the petitioner's request for electricity service connection, taking into account the fact that the petitioner has been residing in the said premises for over 35 years. However, the petitioner shall give an indemnity to the respondent that as and when Slum Clearance Board initiate proceedings, the electricity service connection can be disconnected. On the basis of this indemnity being given, electricity service connection shall be given to the petitioner within a period of two weeks from the date of indemnity being furnished by the petitioner. With the above directions, this writ petition is disposed of.
