Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 31.12.2018 for transfer of patta in respect of the Agricultural Dry land measuring to an extent of 2.60 acres comprised in Paimash No.30 of Chennasandiram Village (Elesandram), Hosur Taluk, Krishnagiri District within the time to be stipulated by this Hon'ble Court.

2. Heard both sides.

3. The petitioner seeks for a Mandamus directing the respondent to consider his representation dated 31.12.2018, wherein and whereby, he sought for transfer of patta in respect of the Agricultural dry land measuring an extent of 2.60 acres comprised in Paimashi No.30 of Chennasandiram Village (Elesandram), Hosur Taluk, Krishnagiri District. https://hcservices.ecourts.gov.in/hcservices/

4. It is stated by the petitioner that the subject matter land was purchased by him on 14.12.2018 vide Document No.21521 of 2018 and he has been in peaceful possession and enjoyment of the said land. It is further stated that to develop the said land, the petitioner approached the Banks for availing agricultural loan and the Bank official insisted him to submit patta in respect of the said land. Thereafter, the petitioner sent a representation on 31.12.2018 to the respondent seeking for transfer of patta in his name. The grievance of the petitioner is that the said request has not been considered by the respondent so far. Hence, the petitioner filed the present writ petition with the relief as stated supra.

This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the respondent to consider and decide the same on merits and in accordance with law. Accordingly, this writ petition is disposed of, only by directing the respondent to consider the representation of the petitioner dated 31.12.2018 and pass orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
