Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus to call for Natham Kariyaseri Patta No.1649 from the file of the 1st respondent and quash the same and direct the 1st respondent to restore the Patta No.1335 in the name of the petitioner.

The petitioner is aggrieved against the proceedings of the first respondent Tahsildar, granting patta in favour of the respondents 4 and 5 in respect of the subject matter land. https://hcservices.ecourts.gov.in/hcservices/

2. According to the petitioner, the names of the respondents 4 and 5 are wrongly included in the patta, while the same was standing in the name of the petitioner's father V.Kanniyappa Udayar.

3. If the petitioner is having any grievance against the patta proceedings, he has to resort to the remedy available under the Patta Pass Book Act and hence, filing a Writ petition like this, is not the proper course of action. Therefore, without expressing any view on the merits of the contentions raised by the petitioner, this writ petition is disposed of by granting liberty to the petitioner to file an Appeal before the Revenue Divisional Officer, namely the second respondent, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
