Respondents PRAYER : Writ petition filed under Article 226 of the Constitution of India praying for a writ of Declaration, declaring that the order of the 3rd respondent dated 11.10.2010 bearing Ref.Ho:HRM:PEN:7754/2010-11 and the proceedings of the 2nd respondent dated 21.08.

2010 bearing HRM:92/2010-11 in so far as not permitting the petitioner who had been compulsorily retired from service of the Respondent Bank from exercising option to join the pension scheme under the Indian Bank (Employees') Pension Regulations, 1995 as illegal, arbitrary, contrary to law, in violation of Article 14 of the Constitution of India and consequently direct the respondent Bank to accept the option of the petitioner to join the Indian Bank (Employees') Pension Regulations, 1995 and pay pension from the day when the petitioner is eligible to draw pension, pay pension arrears and permit the petitioner to commute the value of pension within the time frame stipulated by the petitioner. ORDER

Today, the Writ Petition is listed under the caption "for withdrawal" based on the letter dated 12.11.2018 submitted by the learned counsel appearing for the petitioner. The learned counsel for the petitioner also sought permission of this Court to withdraw this writ petition and he has also made an endorsement to that effect.

2. In view of the submission and endorsement made by the learned counsel for the petitioner, this writ petition is dismissed as withdrawn. No costs.
