The above petitions been filed to extend the time granted by this court and also modify the condition imposed on the petitioner to appear before the respondent police on every Wednesday at 10.30 a.m. for the period of eight weeks and thereafter as and when required for interrogation in the above Crl.O.P.No.3044 of 2023 dated 08.02.2023.
2. The learned counsel for the petitioner submitted that the petitioner is duly complying the condition imposed on him by this Court to appear before the respondent police on every Wednesday at 10.30 a.m. for the period of eight seeks. However, he met with an accident and sustained injuries over limbs and thereafter, he undergone surgery, thereby he is unable to move freely and Doctor also advised him to take bed rest. Moreover, the distance between petitioner's house to the respondent police is more than 200 kms.and hence, it is very difficult for 1/3
him to comply the condition. Therefore, he has filed this petition to modify the condition.
3. The learned Government Advocate (Crl. Side) would submit that so far, the petitioner has not complied the condition imposed by this court.
4. Considering the above submission, the condition to report before the respondent police is modified to that effect that the petitioner shall report before the respondent police as and when required for interrogation.
5. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 3044 of 2023 vide order dated 08.02.2023 shall remain unalterted.
6. Time is extended for further period of two weeks for complying the order from the date of receipt of copy of this order. 17.03.2023 rpp 2/3
