Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the second respondent to Constitute to the Selection Committee and to appoint the petitioner as a Child Nutrition Worker (Anganwadi Paniyalar) at Pindithangal or Pudur Villages, Kalavai Taluk, Ranipet District to consider and dispose of the petitioner's representation dated 05.10.2020 by issuing necessary directions and for consequential orders.

By consent, this Writ Petition is taken up for final disposal.

2. The prayer in this Writ Petition is for a Mandamus directing the second respondent to Constitute a Selection Committee and to appoint the petitioner as a Child Nutrition Worker (Anganwadi Paniyalar) at Pindthangal or Pudur Villages, Kalavai Taluk, Ranipet District to consider and dispose of the petitioner's representation dated 05.10.2020 by issuing necessary directions and for consequential orders.

3. The third respondent has filed a detailed counter affidavit dated 30.04.2021, wherein it has been stated as under:

"8. It is further submitted that the eligible candidates for appointment of the post of Child Nutrition Workers to the concerned village, the concerned District Collector is only the competent appointing authority on the basis of the recommendations of the Selection Committee consisting and also followed the eligibility of norms for priority contained in the G.O.Ms.No.110 dated 14.05.2012 and also followed the Rule of Communal Rotation - 200 Units as per G.O.Ms.No.55, Personnel and Administrative Reforms Department dated 08.04.2010, Priority / Non Priority along with communal rotation as per G.O.Ms.No.142, Personnel and Administrative Reforms Department dated 14.10.2009 and List / Order of Priority as per G.O.Ms.No.188, Personnel and Administrative Reforms Department dated 28.12.1976.

9. It is further submitted that as per the above said Government Orders, the said Pindithangal and Pudur Villages, Kalavai Taluk, Ranipet District are comes under the PrioritysCentres. Hence, the selection committee was not recommended any one of the candidates for the said post and the post of Child Nutrition Workers at Pindithangal and Pudur Villges, Kalavai Taluk, Ranipet District is still vacant as on date.

10. It is further submitted that when the Government directed to fill up the vacancy of Child Nutrition Workers at Pindithangal and Pudur Villages, Kalavai Talik, Ranipet District the department will take necessary further course of

action to fill up the vacancy of Child Nutrition Workers at Pindithangal and Pudur Villages, Kalavai Taluk, Ranipet as per the rules and regulations and also the norms prescribed by the Government."

4. Recording the stand taken by the third respondent in the counter affidavit, this Writ Petition stands disposed of. No costs.
