Defacto Complainant PRAYER: This Criminal Original Petition filed under Section 482 Cr.P.C. to call for the records of the Inspector of Police, S-10 Pallikarani Police Station, Chennai, the 1st respondent herein, pertaining to the First Information Report registered in Crime No. 281 of 2009 dated 29.04.2009 and quash the same as unjust, arbitrary, beyond the jurisdiction and against principle of natural justice.

This Criminal Original Petition has been filed to call for the records of the Inspector of Police, S-10 Pallikarani Police Station, Chennai, the 1st respondent herein, pertaining to the First Information Report registered in Crime No. 281 of 2009 dated 29.04.2009 and quash the same.

2. Learned counsel for the petitioner would submit that due to land dispute, a false complaint has been filed against the petitioners in Crime No.281 of 2009. He would submit that 1st respondent only with an aim to pacify the 2nd respondent, had registered the FIR. Though FIR has been registered on 29.04.2009, there is no progress even after a lapse of 13 years. He would further submit that three accused arrayed in this case are Senior Citizens.

3. Learned Additional Public Prosecutor would submit that it is a case and case in counter and the grounds raised by the petitioner are factual in nature.

4. Heard the parties and perused the materials available on records.

5. In view of the above, this Criminal Original Petition stands disposed of. However, a direction is issued to the respondent Police to complete the investigation and file the final report as expeditiously as possible, preferably within a two months from the date of receipt of a copy of this order.
