SESHASAYEE CRIMINAL MISCELLANEOUS PETITION No.3173 of 2020 IN CRL OP.3542/2020 B.FAIZAL [ PETITIONER ] Vs STATE REPRESENTED BY [ RESPONDENT ] THE INSPECTOR OF POLICE, KOVILPALAYAM POLICE STATION, COIMBATORE, COIMBATORE DISTRICT ( CRIME NO. 17/2020) Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed on the petitioner in point no. 6(b) to appear before the Respondent Police daily at 10.30 am 2.30 p.m and 5.30 p.m until further orders in Crl.O.p.No.3542 of 2020 dated 19.02.2020.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. K.BALASUBRAMANIAM, Advocate for the petitioner and of MR. C.RAGHAVAN, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition is filed to modify the condition imposed on the petitioner in paragraph No.6(b) of the order of this Court dated 19.02.2020 in Crl.O.P.No.3542 of 2020.

2. The learned counter for the petitioner submitted that when the petitioner was in the process of complying with the earlier condition imposed by this Court, Vide its order dated 19.02.2020, the petitioner encountered an incident on 02.3.2020, by which, some of the police personnel attached to the respondent-police tried to implicate him in another case. The learned counsel for the petitioner submitted that the petitioner has been secured.

3. Heard the submission of the learned Government Advocate (Criminal Side) appearing for the respondent.

4. Considering the submissions made by the learned counsel appearing for the petitioner, the condition imposed as against the petitioner in Crl.OP.No.3542 of 2020, is modified to the effect that the petitioner shall now appear and sign before the concerned Judicial Magistrate Court.
