No.

13373 of 2021 and to pass such further or other order as this Hon'ble Court may think fit and proper in the circumstances of the case and thus render justice. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.S.LAKSHMANASAMY, Advocate for the petitioner and of MR.S.SANTHOSH, Govt. Advocate ( Crl. Side)on behalf of the Respondent the court made the following order:- This Criminal Miscellaneous Petition has been filed by the petitioner to extend the time for another three months from 11.04.2022, enable the petitioner to surrender his passport bearing No.Z4460988 before the Special Court for the cases under the Prevention of Corruption Act, Chennai by complying the order passed by this Court, dated 17.12.2021, made in Crl.M.P.No.13373 of 2021.

2. The petitioner herein has gone to Australia pursuant to the permission granted by this Court. However, the permission gets lapsed on 11.04.2022. This petition is taken out for extension of time for return back to India in view of certain facts stated in the petition.

3. The learned Government Advocate (Crl. Side) appearing for the respondent states that the investigation is completed and sanction to prosecute is awaited. Once sanction is granted, final report will be filed.

4. Taking note of the said fact and the reasons stated by the petitioner for extension of time to return back to India and surrender the passport, this Court permits the petitioner herein to stay in Australia for another period of two months and shall return back to India on or before 11.06.2022. In case, if the prosecution requires his presence before the said date i.e., 11.06.2022, the respondent shall intimate the petitioner stating the reason for his presence and date on which the petitioner must be present. Such notice shall be served atleast seven days prior to the date of his requirement to be present in India. The petitioner herein is directed to give his full contact address of Australia and E-mail address to the Investigating Officer.
