Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus or any other appropriate writ, order or direction in the nature of writ, directing the respondents to consider the Petitioner's representation dated 17.03.2022, accord permission and provide adequate and proper Police Protection to the demonstration proposed to be organized by the Petitioner on any date, on or before 26.03.2022, that may be fixed by this Hon'ble Court. O R D E R

The Writ Petition has been filed to direct the respondents to provide adequate and proper Police Protection to the demonstration proposed to be organized by the Petitioner on any date, on or before 26.03.2022, by considering the Petitioner's representation dated 17.03.2022.

2. Learned counsel for the petitioner would submit that the petitioner is the District Secretary - CITU and Deputy Secretary of the Vellore District Tannery and Shoe Manufacturing Workers Red Flag Union affiliated with the CITU Trade Union. The Trade Union is registered under the Trade Unions Act and its registration number is 1508/VLR and its main objective is to protect the rights and liberty of the workers working in the Tannery and Shoe Manufacturing Companies in and around the Ranipet and Vellore Districts. TATA Internation (Baachi Shoes Division) - Unit D1, had suspended certain workers illegally after nearly 130 workers joined in Petitioner's Trade Union. In order to show protest against the illegal suspension of workers, petitioner's union had intended to conduct a demonstration at the notified place on or before 26.03.2022.

The petitioner's trade union had sent a representation on 17.03.2022 for grant of permission and adequate police protection, whereas the Respondent had not passed any orders. He would reiterate that the place where they intended to conduct the demonstration is already a notified place and several protest and demonstrations were allowed to be conducted at that place.

3. The learned Additional Public Prosecutor appearing for the respondent would submit that the representation of the petitioner will be considered and permission will be granted subject to reasonable restrictions.

4. Recording the same, the first respondent is directed to consider the representation of the petitioner dated 17.03.2022 and accord permission and adequate Police Protection to the demonstration subject to reasonable restrictions.

5. Accordingly, the Writ Petition stands disposed of with the above directions. However, there shall be no order as to costs.
