PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 24.02.2022 forthwith and consequently direct the respondents to disburse the amount assured under the Policy No.713087146 dated 28.12.2000 and 714297730 dated 25.03.2006 for a sum of Rs.50,000/- and Rs.1,00,000/- respectively with interest at 18% per annum. Heard Ms.N.Likitha Prasad, learned counsel for the petitioner and Mr.Deepak Narayanan, who accepts notice for the respondents.
2.The prayer of the petitioner is for a mandamus directing the respondents, the Life Insurance Corporation of India and its officials, to consider her representation dated 24.02.2022 forthwith, and consequently disburse the amount assured under Policy Nos.713087146 dated 28.12.2000 and 714297730 dated 25.03.2006 for a sum of Rs.50,000/- and Rs.1,00,000/- respectively, with interest at 18% per annum. 3.The representation of the petitioner is very proximate to the filing of this Writ Petition. Though normally this Court would not have been inclined to consider such a request, learned counsel for the petitioner draws the attention of this Court to the legal notice that has been issued on 31.12.2021 that indicates that the petitioner has been in touch with the respondents even from thereon in regard to her insurance claims.
For this reason, this Writ Petition is entertained. 4.That apart, learned counsel for the respondents expresses no objection to the mandamus as sought for by the petitioner. Hence, the respondents are directed to consider the representation of the petitioner dated 24.02.2022, cause proper enquiry and dispose the same after hearing the petitioner and any other party/parties that the respondents believe are necessary for proper adjudication of the matter and settle the claims of the petitioner in accordance with law and applicable Rules and Regulations, within a period of eight (8) weeks from today.
