JUDGMENT
(The judgment of this Court was made by S.M.Subramaniam,J.,) The appellant is a third party to the writ proceedings instituted by the second respondent Srimathi. M.Devaki, who is none other than the mother of the appellant.
2.The writ petition came to be filed challenging the show cause notice issued by the Sub-Registrar, Singanallur, Coimbatore District dated 19.06.2024 asking the second respondent to produce the copy of the parent document No.1263/1981 to verify the title of the presentment of the document for registration.
3.Instead of filing the said document by submitting an explanation, the second respondent has chosen to file the writ petition. The writ petition was allowed only on the ground that the principle laid down in the case of N.Ramayee Vs. Sub-Registrar reported in (2020) 6 CTC 697 to be applied and consequently, the writ petition was allowed. 2/4
4.Now, it is brought to the notice of this Court that the subject document was registered by Sub-Registrar, Singanallur on 13.05.2024 in document No.10034/2024, even before passing of the impugned writ order on 23.07.2024. Pertinently, the appellant has instituted a civil suit in O.S.No.930 of 2023, which is now pending on the file of the first Additional District Court, Coimbatore. Thus, the parties are at liberty to work out their remedy before the civil Court. With this observation, the writ appeal stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
