Mr.S.N.Parthasarathi, learned Government Advocate, takes notice for the respondents. By consent, the main Writ Petition is taken up for disposal at the admission stage itself.
2.The petitioner has filed the above Writ Petition to issue a writ of mandamus directing the third respondent to consider the petitioner's representation dated 16.05.2017 and direct him to measure the petitioner's land comprised in survey No.325/20 at Chinna Mariamman Koil Street, Konganapuram, Ettapadi, Salem District, measuring to an extent of 818 sq.ft.
3.The learned counsel for the petitioner submitted that inspite of the petitioner's representation dated 16.05.2017, the third respondent has not surveyed his land so far. Further, the learned counsel submitted that the petitioner https://hcservices.ecourts.gov.in/hcservices/
would produce all the relevant records before the third respondent and pay the necessary charges for surveying the land.
4.Mr.S.N.Parthasarathi, learned Government Advocate appearing for the respondents, submitted that on production of all the necessary records and payment of necessary charges, the third respondent may be directed to consider the petitioner's representation dated 16.05.2017 and pass orders in accordance with law, after giving notice to all the interested parties.
5.Having regard to the submissions made by the learned counsel on either side, without expressing any opinion with regard to the merits of the case, I direct the third respondent to consider the petitioner's representation dated 16.05.2017, on production of all the necessary documents by the petitioner and payment of necessary charges for surveying the land and pass orders in accordance with law, after giving notice to all the interested parties, within a period of eight weeks from the date of receipt of a copy of this order. 6.With this observation, the Writ Petition is disposed of. No costs.
