ORDER

This Writ Petition has been filed for the following reliefs:- "calling for the records pertaining to the order passed by the 3rd respondent in his proceedings No. Na.Ka. No.777/Aa3/2015 dated 23.09.2021 and quash the same and direct the respondents to approve the appointment of the petitioner as B.T. Assistant (Science) from the date of her appointment on 01.06.2012 and confer all the consequential benefits.

It is the case of the petitioner is that on 01.06.2012, the 5th respondent management appointed the petitioner as BT Assistant (Science) in the vacancy arising out of the promotion of one Mrs. Nirmala. The said post is a regular sanctioned post. On 26.06.2012, the proposal for approval of the petitioner's appointment as BT Assistant (Science) with effect from 01.06.2012 in the 5th respondent school was forwarded to the Educational Authorities.

3. The 4th respondent vide proceedings dated 19.11.2012 had rejected the proposal to approve the appointment of the petitioner on the ground that the __________Page 2 of 6

petitioner has not acquired TET eligibility. As a result, the appointment of the petitioner as B.T. Assistant (Science) was not approved and the petitioner was working without salary from 01.06.2012. Challenging the said rejection, the petitioner had filed WP.No.8101 of 2015. This Court by order dated 20.07.2016 passed an order directing the Government to release the salary and also pay the arrears of salary within a period of two months. After the aforesaid order was passed, a fresh representation has been sent by the fifth respondent to the third respondent on 09.05.2019. As the said representation has not yielded any order, the petitioner had once again filed WP.No.17240 of 2021. This Writ Petition was disposed of on 23.08.2021 directing the third respondent to pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order. Thereafter, the third respondent by proceedings dated 23.09.2021 once again rejected the petitioner's approval citing the very same reason. Challenging the same, the petitioner is before this Court.

When the matter came up for hearing, the learned Government Advocate appearing on behalf of the respondents would submit that the proposal for approval of the petitioner's appointment to the post of B.T.Assistant (Science) in the fifth respondent school is now pending before the District Education Officer, the third respondent herein and the same would be considered positively.

In view of the submissions made by the learned Government Advocate, the District Education Officer/the third respondent is directed to pass orders approving the appointment of the petitioner as BT Assistant (Science) in the fifth respondent school, within a period of three weeks from the date of receipt of a copy of this order. Considering the fact that the approval sought is in respect of a regular sanctioned post, the District Education Officer shall pass orders without being influenced by the earlier orders.
