The present Application had been filed to grant leave to the applicants to file the above suit before this Court.

2.Considering the fact that there are properties which are also situated within the jurisdiction of this Court, this Court is of the view that the Suit can be tried before this Court and hence, the leave to sue for the properties situated outside the jurisdiction of this Court can be granted. Similarly the defendants 2,3,5 & 6 who are also residing outside the jurisdiction of this Court can be sued before this Court, as the present Suit is for a Suit for partition.
