ORDER
This writ petition has been filed, challenging the impugned refusal check slip dated 21.01.2026 issued by the third respondent, refusing to register the power of attorney dated 21.01.2026, presented by the petitioner for registration on the ground that the petitioner has not produced the original title deed pertaining to the subject property.
2.The petitioner has challenged the impugned refusal check slip on the ground of violation of principles of natural justice and on the ground that it is a non-speaking order with regard to the contentions of the petitioner as raised in this writ petition.
3.Mr.U.Baranidharan, learned Special Government Pleader accepts notice on behalf of the respondents.
4.Admittedly, as seen from the impugned refusal check slip, no opportunity of hearing was granted to the petitioner by the third respondent before passing the impugned refusal check slip dated 21.01.2026.The contentions of the petitioner as raised in this writ petition has also not been considered in the impugned refusal check slip dated 21.01.2026.
5.Being a non-speaking order and an order passed in violation of principles of natural justice, this Court, in the interest of justice, deems it fit to quash the impugned refusal check slip dated 21.01.2026 and remand the matter back to the very same respondent for fresh consideration, on merits and in accordance with law.
6.The petitioner shall submit a detailed written explanation as to how he has satisfied the requirements of the respondents for registering any document, more particularly, the power of attorney dated 21.01.2026, presented by the petitioner for registration, within a period of one week from the date of receipt of a copy of this order. On receipt of such written explanation from the petitioner within the stipulated time, the third respondent, after providing one opportunity of personal hearing to the petitioner, shall take a final decision as to whether the power of attorney dated 21.01.2026 shall be registered or not, within a period of 12 weeks thereafter. If the third respondent decides not to register the power of attorney, the third respondent shall pass a speaking order with regard to the contentions of the petitioner and the supporting documents produced by the petitioner.
