ORDER

This Criminal Original Petition has been filed seeking a direction to the Respondent Police to register the case based on the Complaint dated 12.05.2016 (CSR No.186 of 2016) preferred by the Petitioners' Association.

2. Heard the learned counsel appearing for the petitioner and the learned Additional public prosecutor appearing for the respondent.

3. It is the case of the petitioner that opposite party had encroached common area of the Flat System. In this regard, the petitioner has given a complaint dated 12.05.2015, on such complaint, petition enquiry is pending in CSR No.186 of 2016.

In a case of this nature, no positive direction can be issued as prayed for by the petitioner and this petition is closed, with liberty to the petitioner to workout his remedy in the manner known to law.
