Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, forbearing the 1st respondent from rejecting the participation of the petitioner in the tender in Tender Notice No. 45/2025-2026/ HDO dated 10.02.2026 and consequently direct the 2nd respondent to forthwith inspect the work site and the petitioner's plants and machineries based on the request of the petitioner dated 13.02.2026 and 16.02.2026 and issue the Work Site Inspection Certificate and Working Condition of the Plants & Machineries Certificate to enable the petitioner to participate in the tender process.

O R D E R

This writ petition is filed for the following relief: "To forbear the 1st respondent from rejecting the participation of the petitioner in the tender in Tender Notice No. 45/2025-2026/ HDO dated 10.02.2026 and consequently direct the 2nd respondent to forthwith inspect the work site and the petitioner's plants and machineries based on the request of the petitioner dated 13.02.2026 and 16.02.2026 and issue the Work Site Inspection Certificate and Working Condition of the Plants & Machineries Certificate to enable the petitioner to participate in the tender process."

2. The petitioner is a registered contractor with the Tamil Nadu Highways Department. The respondents issued a tender notice dated 10.02.2026 and the same was scheduled to be closed on 23.02.2026. As per tender condition, the petitioner has to apply for the work site inspection and submit the certificate along with the tender application. Though the petitioner duly submitted his application for inspection on 13.02.2026 and 16.02.2026, the 2nd respondent has wilfully delayed and 3/6

refused to conduct the inspection, thereby preventing the petitioner from uploading the mandatory certificates and participating in the tender process scheduled to be closed on 23.02.2026. Hence, the petitioner has filed this writ petition.

3. It is informed by the learned Additional Advocate General that officials would be going to the site today in the afternoon.

4. The petitioner shall be available at site and it is also stated that all the documents have not been submitted by the petitioners which shall be submitted by the petitioner.

5. Recording the same, this writ petition is disposed of. The worksite certificate and plant and machinery certificates will be issued subject to all the documents been presented by the petitioner. Consequently, the connected miscellaneous petition is closed. No costs.
