The petitioner, who was arrested and remanded to judicial custody on 24.02.2023, for the alleged offences punishable under Sections 120(B), 395 & 397 of IPC, in Crime No.26 of 2023, on the file of the respondent Police, seeks bail.

The case of the prosecution as per the de-facto complainant/Subbarao, is that the accused conspired together and by claiming themselves as Police Personnel, robbed a sum of Rs.1,40,00,000/- from the de-facto complainant, who brought the said amount from Andhra Pradesh to purchase gold in Chennai. Hence the case.

Learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case, only based on the confession statement recorded from the arrested co-accused. He further submitted that the main accused in this case have been arrested and also

released on bail. He also submitted that a sum of Rs.75,30,000/- has been recovered from the arrested accused. He also stated that the petitioner is in custody from 24.02.2023 and he is prepared to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner along with other accused conspired together and by claiming themselves as Police Personnel, have robbed a sum of Rs.1,40,00,000/- from the de-facto complainant. He further submitted that the petitioner is the master mind for the said offence. He further submitted that four previous cases are pending as against the petitioner, hence, he opposed for grant of bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

Taking into consideration the facts and circumstances of the case, the submissions made by the learned Additional Public Prosecutor and taking note of the fact that the petitioner was arrested very recently on 24.02.2023 and also considering the previous cases pending against the petitioner, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed for the present.
