Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.A.No.492 OF 2021 on the file of the High Court, the High Court will be pleased to SUSPEND THE SENTENCE imposed in S.C.No.130 of 2016 dated 14.09.2021 on the file of Magalir Neethimandram Sessions Judge, Allikulam at Egmore and ENLARGE THE PETITIONER ON BAIL, pending disposal of the above CRL.A.No.492 OF 2021.

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL.A.No.492 OF 2021 on the file of the High Court and upon hearing the arguments of M/S.B.A.PRAKASH, Advocate for the petitioner and of MR.LEONARD ARUL JOSEPH SELVAM, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- Heard both sides.

2.In the dying declaration recorded from the deceased, she has stated about the occurrence as the petitioner herein is the drunkard and after consuming alcohol regularly beaten her. Further, the alleged occurrence had happened in the presence of the petitioner.

3.Therefore, considering the facts and circumstances of the case, this Court is not inclined to allow this petition.
