The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 457 and 380 of IPC, in Crime No.5 of 2023, seek anticipatory bail.
2. The case of the prosecution is that the petitioner had committed theft of Sain Lovis BDY 180 Ml of 48 bottles, SNJ VSOP BDY 180 ml of 48 bottles, Elcanso brandy 180 ml of 48 bottles and British Empire can beer 500 ml of 24 bottles from the TASMAC worth about Rs.45,200/-. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. Per contra, the learned Government Advocate(Crl.Side) for the respondent would submit that the petitioner is a habitual offender, against him, there are nine previous cases. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Taking into consideration the facts and circumstances of the case and the submissions made by the learned Counsel on both sides and also taking note of the fact that the petitioner is a habitual offender, against him, there are nine previous cases, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
